本利用規約（以下「本規約」）は、Larry Works（以下「運営者」）が提供する「さわやか待ち時間」（以下「本アプリ」）の利用条件を定めるものです。
ユーザーは、本アプリをダウンロードまたは利用した時点で、本規約とプライバシーポリシーに同意したものとみなされます。同意できない場合は、本アプリを利用しないでください。
本アプリは、運営者が独自に提供する非公式の待ち時間確認アプリです。「炭焼きレストランさわやか」およびその運営会社とは一切関係がなく、同社の承認や協力を受けたものではありません。店舗やサービスに関するお問い合わせは、本アプリではなく同社の公式窓口へお願いします。本アプリについて同社にお問い合わせいただくことはご遠慮ください。
本アプリに表示する待ち時間、営業状況、店舗情報は、公開されている情報を一定の間隔で取得して表示しているものです。取得の時点と実際の状況にはずれがあり、取得に失敗して古い情報や空欄が表示されることもあります。運営者は、情報の正確性、完全性、最新性を保証しません。来店の判断は、店舗の公式情報もあわせてご確認のうえ、ご自身の責任で行ってください。
運営者は、ユーザーに対し、本規約に従って本アプリを個人的かつ非商業的に利用する、譲渡不能・非独占的な権利を許諾します。本アプリのプログラム、デザイン、文章などの権利は、運営者または正当な権利者に帰属します。
本アプリでは、広告を非表示にする有料アイテムを購入できます。価格はアプリ内およびストアの購入画面に表示されます。支払いは App Store または Google Play を通じて行われ、返金は各ストアの規定に従います。機種変更や再インストールのあとは、メニューの購入の復元から購入内容を復元できます。
本アプリは Google AdMob による広告を表示します。広告の内容や、広告から移動した先のサービスについて、運営者は責任を負いません。広告に関する情報の取り扱いはプライバシーポリシーをご確認ください。
ユーザーは、次の行為をしてはなりません。
本アプリは現状のまま提供され、運営者は、不具合がないこと、中断なく動作すること、特定の目的に適合することを保証しません。法令で認められる範囲で、本アプリの情報を信頼したこと、または本アプリを利用できなかったことによって生じた損害（待ち時間の違いによる損害を含みます）について、運営者は責任を負いません。
運営者は、本アプリの内容を変更し、または提供を一時停止・終了することがあります。情報の取得元の変更などにより、予告なく一部の機能が使えなくなることがあります。
App Store から本アプリを入手した場合、本規約に加えて Apple の標準使用許諾契約（https://www.apple.com/legal/internet-services/itunes/dev/stdeula/）が適用されます。本規約と矛盾する場合は、その範囲で Apple の標準使用許諾契約が優先します。
運営者は、必要に応じて本規約を変更することがあります。変更後の本規約は本ページに掲載した時点で効力を生じ、その後に本アプリを利用した場合は、変更後の本規約に同意したものとみなされます。
本規約は日本法に準拠します。本アプリに関して紛争が生じた場合は、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Use (the "Terms") govern your use of "Sawayaka Wait Time" (the "App"), provided by Larry Works ("we" or "us").
By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App.
The App is an unofficial wait-time app provided independently by us. It is not affiliated with, endorsed by, or supported by "Sumiyaki Restaurant Sawayaka" or the company that operates it. For questions about the restaurants or their services, please contact the company's official channels, not us; please do not contact the company about the App.
The wait times, opening status, and restaurant information shown in the App are taken from publicly available information at regular intervals. They may differ from the actual situation at the time you view them, and outdated or blank values may appear if retrieval fails. We do not guarantee that the information is accurate, complete, or up to date. Please check the restaurant's official information as well and decide on your visit at your own responsibility.
We grant you a non-transferable, non-exclusive right to use the App for personal, non-commercial purposes in accordance with these Terms. All rights in the App's software, design, and text belong to us or their rightful owners.
The App offers a paid item that removes ads. The price is shown in the App and on the store's purchase screen. Payment is processed through the App Store or Google Play, and refunds are subject to each store's policies. After changing devices or reinstalling, you can restore your purchase from the menu.
The App displays ads served by Google AdMob. We are not responsible for the content of ads or for services reached through them. See the Privacy Policy for how advertising data is handled.
You must not:
The App is provided "as is". We do not warrant that it is free of defects, will operate without interruption, or is fit for any particular purpose. To the extent permitted by law, we are not liable for any damages arising from reliance on information in the App or from inability to use the App, including damages caused by differences in wait times.
We may change the App, or suspend or end its provision. Some features may stop working without notice, for example if the source of the information changes.
If you obtained the App from the App Store, Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies in addition to these Terms. Where the two conflict, Apple's Standard EULA prevails to that extent.
We may revise these Terms as needed. Revised Terms take effect when posted on this page, and continued use of the App after that means you accept them.
These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance for any dispute relating to the App.
